19 Observed a vegetable preparation sink with an accordion pipe that goes into the floor drain. Observed a large metal pipe that appears to come from the ware washing machine that was too low near the floor drain. Ensure that both plumbing pipes are given at LEAST a one-inch air gap above the kitchen floor. Ensure that the accordion pipe is replaced with a smooth PVC piping, or metal, or copper piping that does NOT leak. Ensure that all kitchen plumbing maintains an air gap of at least one inch (1”) above the horizontal plane of the floor. If the diameter of the pipe is larger than one inch, then the air gap is double the diameter (example: A kitchen pipe that has a diameter of two inches NEEDS an air gap of at least four inches above the kitchen floor). This shall prevent contamination of the plumbing lines in the event of a sewage backflow. This rule applies to restaurant grade hoses or plumbing that comes from appliances such as ice machines and cold holds. Ensure the following: 5-202.13 Backflow prevention, air gap.
3 Observed cheeseburgers inside of the oven were temping below the required 135 degrees Fahrenheit (F) at the following temperatures: 129 F, 132 F, and 130 F. Ensure that hot Time/ Temperature Control for Safety (TCS) foods have an internal temperature of 135 degrees Fahrenheit or higher when they are within hot holds. If the hot TCS food item is out of temperature for more than four (4) hours, then it MUST be discarded immediately. The Food Handler turned the oven on to reheat the cheeseburgers back above 135 F. Ensure the following: 3-501.16(A)(1) Hot Hold (135°F or higher).
21 Observed that there were only three Food Handlers on site during today’s inspection. The Certified Food Manager left he site ten minutes before the inspector arrived. There MUST always be a Certified Food Manager (CFM) on site during all hours of operation. They are responsible for directing the flow of the kitchen and being knowledgeable about food handling and safety. The inspector highly recommends that two responsible Food Handlers present today are trained to become CFMs. This shall assist the main CFM if they go on vacation, go on a grocery run/ run an errand, or if they call-in sick. The CFM MUST always have an UNEXPIRED certification and they are responsible for renewing the certification before it expires. Ensure the following: 228.31(b) Certified food protection manager shall be present at the food establishment during all hours of operation as required in Food Code, §2-101.11 and §2-102.12. 228.221(a)(4)(A) Certified Food Protection Manager Certification.

29 Observed that the ware washing machine has transitioned from heat treatment to chemical sanitizing to sanitize the food-contact dishes and utensils. The inspector observed that the concentration of the Bleach/ Chlorine sanitizer was at 10 Parts Per Million (PPM). Ensure that Bleach/ Chlorine sanitizers have a concentration of 50 to 100 Parts Per Million (PPM), and Quaternary Ammonium sanitizers have a concentration of 200 to 400 PPM. These concentrations are NEEDED to effectively sanitize food-contact surfaces and nonfood contact surfaces. If the concentrations are too high, then the sanitizers shall contaminate the food-contact and nonfood-contact surfaces of the dishes. If the concentration is too low, then the surfaces shall not be disinfected, and the growth of pathogenic microorganisms shall contaminate the next food item that is placed. The manager has placed a maintenance order with EcoLab to increase the concentration back to 50 or 100 PPM. The inspector instructed the staff to Wash, Rinse, and Sanitize the dishes at the three-compartment sink until EcoLab has fixed the issue at the ware washing machine. Ensure the following: 4-501.116 Concentration of the sanitizing solution shall be accurately determined by using a test kit or other device.
9 Observed a container of raw chicken stored above a flat pan of ground beef. Ensure the correct order for raw meats to prevent cross-contamination. The Certified Food Manager (CFM) moved the pan of ground beef above the container of raw chicken. Ensure the following: 3-302.11(A)(2) Food protected cross contamination separating types of raw animal food storage, preparation, holding, display.

33 Observed mechanical ware washing equipment temperatures reach ~ 156 degrees Fahrenheit (F) max for the Wash cycle, and ~ 126 F for the rinse cycle. Ensure that the maintenance order with EcoLab is completed by the next routine inspection. The temperature as the machine stated, NEEDS to reach 160 F for the Wash cycle, and 180 F for the Rinse cycle to effectively sanitize the dirty dishes. The Certified Food Manager NEEDS to ask the service provider what temperature is NEEDED for both of these cycles (the one stated may be incorrect or outdated). Ensure the following: 4-501.112 Mechanical warewashing equipment, hot water sanitization temperatures.
