15 Observed: Employee cutting fruits for garnish with bare hands and employee assembling shake with ready-to-eat foods (fruits) with bare hands. Corrective Action: Ensure that employees are washing their hands before any food preparation occurs. Use barriers such as gloves or tongs to handle ready-to-eat foods. Wash hands before using gloves, gloves are not substitution for hand washing. As per: 3-301.11(B) Bare hands contact with ready-to-eat foods.
22 Observed: Employee present at time of visit does not have a Certified Food Handler Certificate. Corrective Action: Ensure that employees handling/preparing foods at establishment are with Food Handler Certificate. As per: 228.31(d) Food Handler Training criteria.
21 Observed: Neither of the two employees present at time of visit had a Food Managers Certificate. Corrective Action: At least 1 person per shift with Food Manager Certificate is to be present at all times during business operating hours. As per: 228.31(b) Certified food protection manager shall be present at the food establishment during all hours of operation as required in Food Code, §2-101.11 and §2-102.12. 228.221(a)(4)(A) Certified Food Protection Manager Certification.

Corrective Actions: Ensure that food permit is displayed in an area visible to the public at all times. As per: 8-301.11.1 Permit Requirement, Prerequisite for Operation.
31 Observed: Hand sink obstructed by big cooler containing shaved ice. Hand sink without hand drying provisions. Hand sink basin with rag. Corrective Action: Ensure that hand sink is easily accessible for employees. Have hand drying provisions such as paper towels. Hand sink is only for hand washing purposes and not to store rags or other objects. As per: 6-301.12 Hand drying provision.. 5-205.11 Using a hand washing facility. accessible at all times for employee use; not be used for purposes other than hand washing. 5-204.11 Hand washing facilities. A hand washing facility shall be located: to allow convenient use by employees in food preparation, food dispensing, and ware washing areas; and in, or immediately adjacent to, toilet rooms.
37 Observed: Boxes of fruits, containers of food, and canned goods stored directly on floor. Corrective Actions: Ensure that all foods are at least 6 inches off the floor. As per: 3-305.11(A)(3) Storing the food at least 15 cm (6 inches) above the floor.
39 Observed: Knives stored between wall and pipe. Ladle for ice scoop directly on counter. Corrective Actions: Ensure that utensils are stored in a clean, durable, and easily cleanable container in between-use. As per: 3-304.12(E) In-use utensils, between-use storage. During pauses in food preparation or dispensing, food preparation and dispensing utensils shall be stored in a clean, protected location if the utensils, such as ice scoops, are used only with a food that is not time/temperature controlled for safety.
45 Observed: Window screen in bathroom is torn and no barrier for pest. Corrective Action: Ensure that the window screen in bathroom is in good repair and without tears. As per: 6-501.11 Repairing. The physical facilities shall be maintained in good repair.
37 Observed: Several tubs of ice cream in different freezers without lids. Corrective Actions: Ensure that food containers are with covering at all times when stored. As per: 3-302.11(A)(4) Food protected from cross contamination by storing the food in packages, covered containers, or wrappings.
19 Observed: Pipe under three compartment sink directly going into drainage pipe without an air gap. Corrective Action: Ensure that pipe under three compartment sink is with a minimum 1 inch air gap or twice the diameter of water supply inlet. As per: 5-202.13 Backflow prevention, air gap. An air gap between the water supply inlet and the flood level rim of the PLUMBING FIXTURE, EQUIPMENT, or nonFOOD EQUIPMENT shall be at least twice the diameter of the water supply inlet and may not be less than 25 mm (1 inch).
