19 * 228.146(d) Backflow prevention device, design standard. Observed an Hose Connection Vacuum Breaker with a shut off valve installed after the device. According to the design standard for Atmospheric Vacuum breakers, ASSE 1011. The HCVB is not to be subjected to constant pressure greater than 12 hours. Placing shut off valves after the device creates a condition where the AVB could be subjected to a constant pressure greater than 12 hours. For this reason, shut off valves are restricted after the device. There are several possible fixes for this condition: remove the shut off valves after the HCVB and have it checked for good operation, place a pressure bleed valve after the device and before the shut off valves, or install a backflow prevention device designed for constant pressure applications.
21 * 228.32(2) Being a certified food protection manager who has shown proficiency of required information through passing a test that is part of an Accredited Program. The city amends this in two ways: 1) There must be one CFM in the establishment every shift of 12 or fewer hours; and 2) The CFM must obtain the city issued certificate by completing a course of study acceptable to the director and paying the application fee. The certificate can be obtained by bringing the CFM course certificate to the health the desk at 1901 Alamo St S and paying the $15.45 application fee. The PIC had the required training certificate, but had not obtained the city certificate. The city certificate must be obtained to meet this requirement.
35 228.42(a)(1) Eating food, chewing gum, drinking beverages, or using tobacco. An employee may drink from a clean, closed, spill resistant container in a location that minimizes the risk from spills contaminating food, food service items or single use/service food items. Observed employee drinking from a water bottle. Water bottles are not a closed container when the top is removed. Use a closed container to drink in a location that minimizes the risk to food items.
38 228.75(c)(2) Thawing. under running water criteria. Thawing of TCS food under running water requires the food to be completely submerged under cool (70 degrees Fahrenheit or less) running water. This is to limit hot spots that would remain above 41 degrees Fahrenheit during the thawing process. Observed chicken what was not completely submerged during the thawing process. The chicken packages must be weighted to keep it under water.
38 228.75(c) Except as specified in paragraph (4) of this subsection, time/temperature controlled for safety (TCS) food shall be thawed under refrigeration that maintains the food temperature at 5 degrees Celsius (41 degrees Fahrenheit) or less. There are four methods approved for the thawing of TCS foods: 1) under refrigeration at 41 degrees Fahrenheit or less, 2) completely submerged under continuously running cool water, 3) as part of the cooking process, and 4) in a microwave oven for immediate transfer to a cooking method to complete the process of cooking. Observed packages of frozen food defrosting at room temperature. This can allow parts of the TCS foods to become warmer than 41 degrees for greater than four hours. Use an approved method. Items were transferred to the walk-in refrigerator.
