9 Observed raw, shelled eggs stored above cartons of Organic Soy beverages. The inspector told the staff of the establishment to store the carton of eggs at the very bottom and store the beverages above the eggs. Ensure that raw, shelled eggs and raw meats are stored below Ready to Eat (RTE) foods such as prepackaged, Time/ Temperature Control for Safety (TCS) food and whole produce. Ensure the following: 3-302.11(A)(1) Food protected from cross contamination by separating, storage, preparation, holding, and display.
45 Observed that the floor of the walk-in cooler was littered with cardboard and torn plastic wrapping from beverage packages. The walk-in cooler floor MUST be swept and mopped frequently to prevent accumulation of trash and debris. Ensure that all walls, floors, and ceilings are frequently cleaned and sanitized to prevent accumulation of food debris and trash. Ensure the following: 6-501.12 Cleaning, frequency and RESTRICTIONs.
24 The inspector observed bags of ice inside of a top slide-open freezer unit that only stated “Premier Ice”. The inspector told the staff on site that ice bagged on site MUST have labels that state the name of the business, full address where the ice was produced, and the name of the food (“Ice”). Packaged food and beverages, including bags of ice, REQUIRE a label with the following information: 1. Common Name of the food or beverage (“Ice”). 2. Name of the business/ establishment 3. Full Address of the kitchen/ establishment where the food or beverage was prepared/ cooked. In this case, where the ice was produced. The establishment CANNOT sell the bags of ice until the labels have been placed on the bag and until they Upgrade their food license from Risk 1A to Risk 1B. Another option the establishment has, is to purchase bags of ice from a licensed establishment and resell the bags of ice. The company they purchase it from MUST provide them a copy of their Food Manufacturing License. If the establishment decides to continue to sell bags of ice, then they are REQUIRED to purchase a Food Manufacturing License from the Texas Department of State Health Services (DSHS). Ensure the following: 3-602.11(B)(1) Label include the common name of the food, an adequately descriptive identity statement. 3-602.11(B)(4) Label include the name and place of business of the manufacturer, packer, or distributor.
42 Observed black substances on the inside right wall of the ice machine. This black substance has to be wiped away with a sanitizer towel. Ensure that all Nonfood Contact Surfaces are cleaned and sanitized with Bleach/ Chlorine solutions that have a concentration of 50 to 100 Parts Per Million (PPM), or with Quaternary Ammonium solutions with concentrations of 200 to 400 PPM. This shall prevent the growth of pathogenic microorganisms that can contaminate food, and prevent insects and rodents being attracted. Ensure the following: 4-601.11(C) Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris.
45 Observed equipment, items, and a slot machine taking up space in the backroom. The inspector told the staff to remove any equipment that serves no purpose from inside of the establishment (store it somewhere else). Ensure that any equipment or items that serves no purpose or has no use within the establishment is removed from the establishment or discarded. This shall minimize the chance of pests nesting inside of the equipment. Ensure the following: 6-501.114 Maintaining premises, unnecessary items and litter.
34 Observed four dead pests on the backroom floor and inside the three-compartment sink. Ensure that all dead pests are swept up and thrown away. This shall help in figuring out if there is any new activity. Ensure the following: 6-501.112 Removing dead or trapped birds, insects, rodents, and other pests.
19 Observed a leak at the tip of the faucet of the three-compartment sink. Water would spray out in small streams upwards and spray on the wall behind the three-compartment sink. Ensure that this leak is repaired/ sealed and ensure that the faucet is given an extension so tht it can reach all three-compartments. Another option the establishment has is to purchase a new sink fixture where the faucet easily reaches all three compartments. Ensure that all kitchen and bathroom plumbing are free of leaks and in good repair. Ensure the following: 5-205.15(A) A plumbing system shall be repaired according to the Plumbing Code.
29 Observed that the establishment used two tongs and a ceramic mug to store the tongs for pickles. Observed that the establishment prepared bags of ice and had an ice scooper to make the bags of ice. The inspector did NOT observe any testing strips on site or near the three-compartment sink. The inspector reminded the staff that all food-contact utensils and dishes MUST be Washed (dish soap and water), Rinsed (clean rinse water), and Sanitized (water with Bleach/ Chlorine) every four (4) hours during hours of operation. Ensure that the three-compartment sink is always stocked with testing strips so that the staff can check if the sanitizer concentrations are within acceptable parameters (50 to 100 Parts Per Million (PPM) for Bleach/ Chlorine sanitizers, and 200 to 400 PPM for Quaternary Ammonium sanitizers). The testing strips MUST NOT be expired. Ensure the following: 4-302.14 Sanitizing solutions, testing devices.
31 Observed no disposable paper towels at the bathroom handwash sink. The staff on site explained that strangers who use the bathroom will often take the whole roll. The inspector told the staff that they shall allow them to store the paper towels behind the front counter, but they must take the roll with them every time they go use the bathroom. Ensure that all kitchen and bathroom handwash sinks are stocked with hand soap and disposable paper towels during all hours of operation. The hand soap CANNOT be a bar of soap, liquid dish soap, or hand sanitizer. It MUST be liquid or foam hand soap. Ensure the following: 6-301.12 Hand drying provision.
33 Observed that the establishment did NOT have a mop sink or drain boards for the three-compartment sink. Although the establishment is a Risk 1A, they are selling dairy and raw, shelled eggs within their store. The inspector told the staff to be approved, they MUST install a mop sink that has hot water that reaches 110 F. Two drying shelves/ racks or drainboards MUST be added to the three-compartment sink so that food-contact utensils and dishes may be stored there to air-dry. Ensure the following: 5-203.13 Service sink or one curbed cleaning facility provided. 4-301.13 Drain boards.
45 Observed a hole in the wall of the bathroom where a plumbing pipe goes through. The inspector told the staff to seal/ caulk the gap around plumbing pipe to prevent any pest from entering or escaping into the wall. Observed a hole in the ceiling in the main retail room. The inspector told the staff to seal the hole or purchase a new ceiling panel (they CANNOT be acoustic). Ensure that all walls, floors, and ceilings are smooth, flat, easily cleanable, non-absorbent, durable, and in good repair. Ensure the following: 6-501.11 Repairing. The physical facilities shall be maintained in good repair.

37 Observed beverages on the floor of the main room, underneath the three-compartment sink, and on the floor of the walk-in beer cooler. Ensure all food items, including beverages that are bottled or canned, are raised six inches above the floor. Ensure the following: 3-305.11(A)(3) Storing the food at least 15 cm (6 inches) above the floor.
42 Observed dirty upper surface when you open the cover of the ice machine. Observed dirty debris inside the freezer that holds the bags of ice (at the bootom and along the edges at the top). Ensure the following: 4-601.11(C) Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris.

37 Observed water droplets dropping from a pipe connected to the fan of the walk-in cooler drop on the beers stored below. Ensure that the beers are moved out of the way to prevent environmental contamination. Ensure the following: 3-305.11(A)(2) Storing the food where it is not exposed to splash, dust, or other contamination.
